Terms of Service

1. Services and access

TinyGuard provides a cloud-based management platform for childcare and elder care facilities, including live video monitoring, care event logging, attendance tracking, staff management, family portal communications, billing, Electronic Visit Verification (EVV), and compliance reporting (the "Services").

To use the Services, you must: (a) be a legal entity authorized to operate a care facility; (b) agree to these Terms; and (c) complete account setup including providing a valid payment method. You are responsible for all activities under your account.

HIPAA-regulated facilities must execute a Business Associate Agreement with TinyGuard prior to using features that involve Protected Health Information. See our BAA.

2. Free trial and automatic renewal

New facilities receive a 30-day free trial with full access to the platform at your selected plan tier. A valid payment method is required to start the trial. We do not charge your payment method during the trial.

Your paid subscription automatically begins at the end of the 30-day free trial and renews each billing period until you cancel. At the end of the trial — and at the start of each renewal period thereafter — your payment method is charged the then-current subscription fee for your plan.

Your subscription fee is calculated from your enrollment: a base fee plus per-child and per-camera amounts (currently a base fee from $99/month, $2.50 per enrolled child, and a per-camera fee from $7 per camera that depends on the cloud-retention period you select for each camera). Because the total depends on your facility's enrollment and the retention period you choose for each camera, the exact amount of your first charge is shown to you before the trial converts, and a reminder showing that amount and a cancellation link is sent before you are first charged.

You may cancel at any time, including during the trial, from your dashboard — in no more steps than it took to subscribe. If you cancel before the trial ends, you are not charged. Cancellation of an active (post-trial) subscription is governed by Section 6 (Cancellation).

Founding Partner subscribers are not enrolled in the free-trial auto-renewal; the subscription and refund terms in your executed Founding Partner Agreement govern and supersede this Section to the extent they differ.

3. Plans and pricing

TinyGuard subscriptions are usage-based. All prices are in USD and are charged per month. Each plan combines a per-site base fee, a per-member fee assessed against your enrolled census (per child for childcare; per resident for senior care), and a per-camera fee for each connected camera that depends on the cloud-retention period you select for that camera (see Per-camera fee below). The current public calculator is at tinyguard.co/pricing; the rates below govern your subscription.

Per-camera fee. Each connected camera is billed by the cloud-retention period you select for that camera. The standard retention tiers, each priced per camera per month and including that camera's cloud video retention for the stated period, are:

You select the retention tier per camera, and each camera is billed at its own tier. The 60-day tier is available when configuring cameras from your billing settings after signup; the pre-signup pricing menu shows the 7-, 30-, and 365-day tiers. The per-camera rate is the same regardless of how many cameras a facility connects; there is no camera limit or volume minimum on standard plans. Where applicable law requires a longer minimum retention period for the state your facility identifies as its operating location, TinyGuard provisions retention to meet that requirement and bills that camera at the lowest tier that satisfies the legal minimum. Identifying your facility's operating state accurately is your responsibility; TinyGuard applies retention floors based on the state on file for your facility. Retention beyond the published tiers may be arranged as a custom plan.

Storage fair use. The per-camera fee includes cloud video retention for each camera for the retention period of its selected tier (from 7 days); TinyGuard does not charge per-gigabyte overage fees on standard plans. Storage is provided for ordinary use of the Services — recording from supported cameras at the resolutions and bitrates the Services are designed to produce. If a facility's storage use materially and persistently exceeds what the Services are designed to require for its camera count (for example, feeds re-encoded at resolutions or bitrates the Services do not offer, or use of the archive for content unrelated to facility operations), TinyGuard may notify the facility and work in good faith to return usage to ordinary bounds, including configuration changes or a custom plan. TinyGuard will not delete recordings inside your plan's retention window without prior notice, except as provided in Sections 6 (Cancellation) and 8 (Acceptable use).

Custom or enterprise deployments may instead be governed by an executed order form or custom agreement, which supersedes this Section to the extent it differs. TinyGuard reserves the right to modify plan pricing with 30 days' written notice to the facility owner's email address on file.

4. Payment and billing

Subscription fees are billed monthly on the anniversary date of your plan activation. Fees are non-refundable except as required by law or as described in these Terms. Partial months are not refunded upon cancellation.

Payment processing is handled by Stripe, including card payments and bank (ACH) payments via Stripe's bank-debit and financial-connections services. By providing a payment method, you authorize TinyGuard and its payment processor to charge you for applicable fees. Facility billing invoices are available in the dashboard.

If payment fails, TinyGuard will retry the charge and notify you by email. Accounts more than 30 days past due may be suspended. Data is retained during suspension and restored upon payment.

Tuition billing (collecting tuition from families on your behalf) is an optional feature. Tuition funds are processed through Stripe and settle directly to your facility's connected Stripe account; TinyGuard never takes custody of tuition funds. For each tuition payment, TinyGuard charges a platform processing fee — 1.0% per card payment, or $2.00 flat per bank (ACH) payment — deducted from the amount that settles to your account. This fee is borne by the facility and is not added to what families pay. A different rate may be set in your order form. Stripe's own payment-processing fees apply separately under your Stripe Connected Account Agreement.

5. Hardware

The Raspberry Pi device shipped to your facility remains the property of TinyGuard LLC. Hardware purchased separately from our store is owned by you upon delivery.

Upon cancellation or termination of your subscription, you must return the TinyGuard-provided Pi device within 14 days using the prepaid shipping label we provide. If the device is not returned within 14 days of the label being issued, a $399 hardware fee will be charged to your payment method on file.

You are responsible for the physical security of any TinyGuard hardware at your facility during the subscription term.

6. Cancellation

During the free trial

Cancel anytime before the trial ends and you are not charged. Cancel from your dashboard ("Cancel subscription") in no more steps than it took to subscribe, or email del@tinyguard.co.

After the trial (active subscription)

Cancel anytime from your dashboard or by email — no advance written notice is required. Your cancellation takes effect at the end of the current paid billing period: you retain access through the end of that period and are not charged for any period after it.

After cancellation

Your data remains available for export for 30 days after your subscription ends. After that 30-day window, all facility data is permanently deleted from our systems. Export your data before cancellation to avoid data loss.

7. Your data

Your data is yours. All facility data — care records, children's information, videos, billing records — belongs to your facility. TinyGuard processes it on your behalf.

You may export all your data in CSV/JSON format at any time through the dashboard. TinyGuard does not sell your data to third parties.

By using AI features (daily reports, observations, incident analysis), you grant TinyGuard the right to transmit relevant care data to our AI subprocessors (Anthropic, OpenAI) for the sole purpose of generating the requested content on your behalf.

If you enable cloud recording, you grant TinyGuard the right to store and serve video segments on your facility's behalf via Cloudflare R2. By granting this right, your facility warrants that it has obtained all required consents from families, guardians, and residents under applicable law, including COPPA (for children under 13) and applicable elder care privacy statutes.

8. Acceptable use

You agree to use the Services only for lawful purposes. You may not:

  • Use the Services to monitor individuals without their knowledge in violation of applicable wiretapping, surveillance, or privacy laws.
  • Store or transmit content that is illegal, defamatory, or violates third-party rights.
  • Attempt to access, reverse-engineer, or interfere with TinyGuard's infrastructure.
  • Share account credentials or allow unauthorized parties to access the platform.
  • Use the platform to process data for purposes other than operating your care facility.

TinyGuard is a monitoring and management tool. It does not replace required staff supervision ratios, safety inspections, or regulatory compliance measures. TinyGuard LLC is not liable for incidents that occur at your facility, regardless of whether cameras were operating.

TinyGuard may suspend access immediately for material violations of this section and terminate the account if violations are not cured within 14 days of notice.

9. Third-party services

TinyGuard uses trusted third-party service providers to operate the Services, including payment processing (Stripe), cloud infrastructure (Cloudflare, Neon), email and SMS delivery (Resend, Twilio), and AI providers (Anthropic, OpenAI). Your use of features that rely on these providers may be subject to their respective terms of service and privacy policies.

We do not authorize third-party providers to use your data for any purpose other than providing services to TinyGuard. A current list of subprocessors is maintained in our Privacy Policy.

10. Intellectual property

TinyGuard retains all rights to the platform software, branding, and technology. You retain all rights to your facility data. Nothing in these Terms transfers ownership of either party's intellectual property to the other.

You grant TinyGuard a limited license to use your facility name and logo for the purpose of operating and displaying your account within the platform (e.g., your subdomain at yourfacility.tinyguard.co). This license terminates on account cancellation.

AI-generated content (daily reports, suggestions) produced using your facility's data belongs to your facility. TinyGuard does not claim ownership of that content.

11. Limitation of liability

To the maximum extent permitted by law, TinyGuard LLC's total liability arising from or related to these Terms or the Services shall not exceed the amount you have paid to TinyGuard in the twelve (12) months preceding the claim.

TinyGuard LLC shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of data, revenue, or business opportunities, even if TinyGuard was advised of the possibility of such damages.

The Services are provided "as-is" with no guaranteed uptime unless a separate service-level agreement is in effect. Subscribers with a custom or enterprise deployment governed by a separate order form or agreement may request an SLA with defined uptime commitments and support response times under that agreement.

Nothing in these Terms limits liability for gross negligence, willful misconduct, fraud, or any liability that cannot be excluded by law.

12. Modifications to these Terms

TinyGuard LLC reserves the right to update these Terms with 30 days' written notice to your account email. Continued use of the platform after the notice period constitutes acceptance of the updated Terms. If you do not agree to material changes, you may cancel your account before the effective date of the change.

13. Governing law and disputes

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles. Any disputes arising from or related to these Terms or the Services that cannot be resolved informally shall be submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules in Washington County, Oregon, except that either Party may seek injunctive relief in court for intellectual property violations or data security breaches.

This Terms of Service does not constitute a Business Associate Agreement. HIPAA-regulated facilities must execute a separate BAA with TinyGuard.
